If you have any issues with a product we do want to know about them and maintain happy customers, when possible.  But giving back refunds of any sort is NOT something we do any longer.  We have had a lot of people try to take advantage of us, use products partially or mostly and try to get the money back.  As of January, 2016, no-refunds-ever-policy applies 100%.  

We have a longstanding, without exceptions, NO-REFUND-EVER-POLICY.  Tying new products can be risky.  What if YOU don’t like it for some PERSONAL reason?  We request, and insist, that you only try OUR new product with the understanding that you are choosing to try something new, and 100% of the risk is yours, since we have a no-refunds-ever policy.  If you can’t agree to that, please don’t try us out.

As stated above, we have a longstanding, without exceptions, NO-REFUND-EVER-POLICY.  

If an order placed after orders went out that day it USUALLY goes out the next day.  I don’t work weekends and neither does the post office so shipping days are week days.

In the unlikely event you receive a package that was not intended for you or that you did not order, you agree that you will contact us immediately so we may pay for you to return the package or work out an alternative agreement.  Your failure to comply with this agreement Will result in your card being charged for the full price of any item not returned immediately AND a $100 non-compliance / processing fee will be added if you fail to comply.  Do to open someone else’s package.  That is illegal.  Of course you will be compensated if there are any errors, But we are not one of those companies that just lets people keep things if they’re sent out by mistake because that has happened before.  This agreement also authorized Fresh Alt. to come to your house until 11pm to discuss this with you.

About shipping:  Depending on what time of the day an order is placed, it usually ships the next business day, via USPS priority, and then from that point, according to on where you live in the States, can generally take form one to three days to get to you. Tracking information is emailed to you by the United States Post Office when your order ships. Please check your email before asking us to provide you with tracking. If we had to stop and look up your tracking for each person we would have to increase the prices so that is simply not practical to do for each person that calls and wants to know tracking.  If you checked your email and there is no tracking, WAIT A FEW DAYS, and if you still did not get the package then you can ask us to spend some TIME on your situation.  This business model allows us to not have to raise prices.   If you live in a rural location ALL packages take longer to get to you.  Packages are dropped off in Keller, TX, and depending on the direction of your location, it may take an additional day for the package to transit through Fort Worth city before going to you.  That’s why on the cart page it says, “usually 1-2 days”.  Yet, our happiest customers take the common sense approach.  They realize that it saves them money per ounce and saves shipping costs and transit time to order by the pound or kilo versus smaller amounts.  This must be why our average ticket is the pound or kilogram size.  And of course they leave a reasonable cushion of time for processing and shipping when ordering, especially if they live in a rural area.  In the unlikely case we are busy servicing the stores we supply (our first priority) or out of town for a couple days, it may take longer to ship, in which case a generous bonus is added.  This almost never happens, and only happened twice last year, but it is a (very unlikely) possibility that you have just been informed of.  If you forgot to order in advance and want to confirm with us before ordering, just give us a text (preferred) or a call.  We are very happy to text or speak with you!  Emailing is NOT the best way to get ahold of us quickly.  Again, most orders get to people very quickly.  If you have a problem with the post office, like your package sent somewhere else strange or something or you need to agree to deal with the post office yourself, not think that we will re-route it for you or look into it for you.  If something is OUR FAULT, we will take care of it.

Update regarding package delivery: July 1st, 2014.  The priority mail system that we use through the US Post Office has updated their system so that now when sending priority packages the clerk (or the sender if using the kiosk) must enter the entire address into the system.  Now the tracking info tells us that it was delivered exactly to your house instead of just delivered somewhere and they possibility of the carrier having delivered it to the wrong address is no longer there.  This means that we get a confirmation that it was delivered right to your house.  And while we have had plenty of fraud attempts where people say that they did not get their packages.  But now, if the post office says it was delivered to your house, it WAS delivered to your house, and you have no rights or claim to the package once it’s been delivered to your house.  Simply put, you can not claim that you did not get your package if the post office tracking system says it was delivered to your house and in making this purchase you agree to this.

Also, if you put your address in wrong in the order from that is your (buyer) responsibility, not ours.  The address will be cut out of the order form and pasted on the parcel, so it will be shipped to the exact address you put into the form.  And in relation to your rights to the packages, once it’s been delivered to the address that YOU put in the order form, for all practical purposes the package has been delivered and they buyer has no rights to say they did not get the package.  If the delivery attempts were made and you were not home / did not follow up or pick up the package as is your part to do, this is not our problem.  This includes snowbirds, those who order and then go out of town or not available for delivery, creating work for us,that we simply do not accept.  Ordering and then being around for delivery is YOUR part, and those who have had the nerve to do that and ask us for a refund (after we did all that work to package and ship YOUR order) are always denied by us and since you agree to these terms upon purchase, we only need to show this agreement to our bank to win any dispute.  If a package comes back to us that you did not do your part to pick up in your post office or get at YOUR house, you can not have a refund, but you can ask us to reship it at your expense.  We are not responsible if it was at your house and gets lost in the mail on the way back to us either.  Migrant workers and people who live half the year in Florida, for example, can not pass their responsibilities along to us.  If you are not there to get your package you are 100% responsible for following up Our full obligation to you once you purchase is to put postage on it to your address and drop it in the mail and be able to prove that it was shipped to your house, and we need to be able to prove this for 30 days only, since the post office data on the USPS website does not stay there forever.  We also are not responsible for any claimed mistakes of the post office.  Buyer understands that although we try to ship immediately, delays can happen, and if there is a delay that is our fault (rare) customer is compensated with bonus product, fulfilling the obligation to the the customer in full.

If your order is not complete just contact us and it will be corrected.  Connecting us with concerns via public media is not permitted.  You have our cel phone you can text, and that.  Corrections will be shipped in a reasonable amount of time with tracking emailed from usps.  We video-tape the order filling process to avoid scams, and attempts to get extra product are treated as fraud which is illegal.

I generally ship through the kiosk at the post office and they don’t always have the express packages.  Delays are rare but they can happen.  If you order express and I am unable to ship express for whatever reason I will ship priority and make up for the extra shipping you paid with more product.

AGE

Goods may not be purchased by anyone less than 18 years of age. Buyer agrees that all orders may be subject to the requirement of adult signature or other proof of age of Buyer at time of purchase.

SHIPPING
The Seller will make all efforts to ship Goods to Buyer expeditiously. In the event of delay, buyer acknowledges that the Seller is not liable.

RETURNS
We have a no-returns policy unless on mechanical times or un-opened beauty supplies.

SEVERABILITY
The validity of these terms and conditions are not affected by the declaration of one or more of the terms and conditions legally invalid, illegal, or unenforceable. Each term and condition stands on its own merits and shall not be deemed less valid by any seen or unforeseen change in the others, regardless of circumstance.

INDEMNIFICATION/ GOVERNING LAW

These Terms and Conditions, as well as any sale of Goods to Buyer, are deemed to have been agreed to in and occurred in the State of California. Any disputes or interpretation construction, and the remedies for enforcement or breach, are to be applied pursuant to and in accordance with the laws of the State of California. Buyer and Seller expressly agree that all actions or proceedings arising in connection with the sale of any Goods or these Terms and Conditions shall be tried and litigated exclusively in the State or California. The Buyer waives the right to contest exclusive venue by any motion to transfer, motion for forum non-conveniens or related motions.

DISCLAIMER OF LIABILITY
The purpose of this Terms and Conditions agreement is to alleviate any and all liability of the Seller for occurrences where harm or injury resulted from the purchase, use, or misuse of the Goods. By purchasing the Goods you are hereby affirming the following representations:

I am over 18 and an adult under the laws of my State and Country.

I am in good health and am capable of making my own decisions and representations.

The next part is due to a large amount of fraud attempts.

It is the seller’s responsibility to send the items, and once they have been sent the sullen has fulfilled his part of the contract.  Seller is not be responsible for Claims that items are “lost in the mail” or “tampered with in the mail box”.  Again, once sent, the package is considered delivered.  Why?  because with years selling OTHER products in the mail NOTHING IS EVER LOST OR STOLEN, but with THIS herbal product the “claims” of such happen way too often to be chance.  Frankly, more people have tried to DEFRAUD us with this product than any other, ever.  Sad but true.  For a product to be replaced with a police report filed the police report must concluded that the post office stole the product.  In other words, if address on the package is your house and the US post office says you got it, you got it and have no further rights to this package and agree not to claim that you did not get your order in full.  Orders are checked and double checked and photographed.  Orders over $50 are checked by two people.  You (buyer) agree that you will look at your package before signing for it, and if your package is delivered ripped or opened that you will not open it but refuse to sign for it.  This way, any and all potentially damaged stolen or tampered with packages will not be accepted by the buyer and be returned by the post office to the seller.  Again, once the USPS says the package is at your house, you, the buyer, whether you signed for it or not, (we don’t require signature on smaller purchases) have no further claim or rights in the matter of this particular purchase purchase.

NO, we are not a high volume enough business to “just go ahead and replace your item for ya” because you say you did not get it.

SHIPPING ERRORS:  Any and all shipping errors the buyer discovers / claims regarding mail and shopping must be EMAILED to rose@freshalternatives.us in a timely manner that gives us time to work with the current situation, such as ask the post office about forwarding options or re-direct mail.  The seller cannot fail to notify us by email in a timely manner (days) and expect us to simply resend product that we could have attempted to have re-directed through USPS.  The buyer is responsible to enter into contact and STAY IN TOUCH WITH US, emailing and calling frequently UNTIL IT’S RESOLVED.  We want to get your stuff to you but we need your cooperation and without it we can not be responsible.  Customer agrees that claiming they did not get an order that was signed for by them or someone in their household is fraud and may be reported.  Mail crime is a federal offense.

Sent to the billing and not shipping address.  Unfortunately a couple of people have used this “reason” to try to get free product and so please read the following:

Buyer agrees to not order if they can not pick up product at the address they input for the billing address as well.  Your billing address is still your address and mistakes have happened before as have people claimed different things to try to get free product.  So to make it simple, if you absolutely can not get mail at that address this site may not be for you.  We accept no responsibility in the event of an error and you not being able to pick up your order at your other address.  Errors seldom happen but this protects us from people that try to rip us off.  Let’s be real.  Not being able to get a package sent to your billing address is pretty unbelievable anyway, right?  Yes, we’ve had people try this, and no, it did not work for them.

Buyer agrees that if they move / change addresses he / she will leave a forwarding address in a timely manner to avoid complications with shipping and receiving packages.  If buyer fails to follow this practical advise from us (and the US post office) Freshalternatives.us is not responsible packages are not received.

About returns.  In general there is a no refund / no return / no cancellation / no “accidental purchase” policy.  Nobody “accidentally” logs onto a web site and “accidentally” puts items in the card and “accidentally” fills out the credit card info and “accidentally” clicks on the submit button.  If the seller makes an exception and allows the buyer to return an item, which is NOT the norm and will never done if the order has been processed, it must be done before the item is processed.  No, it can’t sit around your house before you decide to return it.  And I (seller) can not use returned product so returned product, although it rarely happens, is a bad situation for me.  We all know that different herbs suit different people’s research better so we encourage buyers to understand that they are buying a plant that can not always be the same as it was last time and that not each person’s research use or application functions in the same manner.  If something comes from my supplier a bit differently that it was before I can’t send it back to him because we are all adults that understand that these are plants we are dealing with.  In other words, it’s not fair to try to hold a small store accountable for your personal experiences and research applications.  Generally, if you are not happy with an herb, do not buy it again, but do NOT try to make us pay for your experimentation.  On the other hand, I do believe in doing good, fair business, that is FAIR FOR THE SELLER AND THE BUYER, so if there is an extreme case like something is damaged (very unlikely) tell us and we will treat it on a case by case basis with NO guarantee of refund or replacement.  We usually ship right away, but sometimes get held up.  If you are one of those people that waits till the last minute to order and then gets pissed if you don’t get your product right away, use someone else.  Order a week ahead and make it easy on everyone involved.

Buyer agrees that attempting to dispute purchases that have been processed is fraud and can be reported to authorities and / or prosecuted.  Again, this is NOT AMAZON.

LIMITATION AND DISCLAIMER OF WARRANTIES

This is a business that does involve international trade in the post office and in the event of a delay in shipping we will include some kind of a free gift but the buyer must understand that there may be a delay on shipping in some unfortunate situations. This is more common to happen with large orders. 1 kg does qualify for a large order. We have a no refund policy absolutely no refunds ever, But, in the rare and unlikely event that you do not get your order within 30 days you will be issued a full refund. This has not happened yet in fact the longest delay we have ever had was six days.
